The tool has already been deployed in over 1,000 assessments at agencies such as the Department of Housing and Urban Development (HUD) and the Consumer Financial Protection Bureau (CFPB). It has been used in 100% of deregulations at the CFPB. The AI tool aims to pinpoint unnecessary or unlawful regulations, potentially saving trillions of dollars through reduced compliance expenditures.
The DOGE AI Deregulation Decision Tool reviews all major regulations and recommends eliminating around 100,000 rules deemed no longer required under federal law. While the AI tool drafts documents and analyses regulations, ultimate decisions are made by agency policy and legal staff, ensuring human oversight to satisfy legal standards.
The novel AI-driven deregulatory approach is expected to trigger new legal questions and challenges. Agencies must follow formal regulatory procedures such as submitting notices for public comment, despite AI assistance. The reasoning behind regulatory changes will be scrutinized by courts.
The DOGE team's PowerPoint includes a timeline for Notices of Proposed Rulemakings (NPRMs) to be created in September, OIRA approvals in October, and the goal of concluding comment periods and issuing final rules in November and December. The work is in its early stages, being conducted in a creative way in consultation with the White House.
The DOGE AI Deregulation Decision Tool aligns with the administration’s broader AI action plan, which includes reducing regulatory barriers to AI innovation and speeding federal permitting for AI infrastructure.
